- Be at least 18 years of age when lodging a visa application
- Be in Australia when lodging the visa application and when the visa is approved
- Be in a relationship with a spouse or a de facto partner who is either an Australian citizen, an Australian permanent resident, or an eligible New Zealand citizen who can be a visa sponsor
- Comply with health and character requirements
- Have no debt to the Australian government, or have arranged to pay off such a debt
Partner Visa Subclass 801 Criteria
- Have a temporary partner visa subclass 820
- Be in a continuing relationship with your spouse or de facto partner unless the relationship has ended due to extraordinary circumstances
- Adhere to all the laws and conditions related to the partner visa subclass 820
- Have not had a visa cancelled or refused while living in Australia with a 820 visa
