Prospective Marriage Visa
The Prospective Marriage Visa (subclass 300) provide an opportunity for an applicant, usually a fiancé, to enter into Australia with the intention of marriage. An important condition of this visa is that it is only valid for 9 months which means the applicant must be married within this period. This visa allows the applicant to stay, travel, work and study in Australia until its expiration.
Criteria For The Applicant
In most cases, the applicant must be the fiancé of an:
- Australian citizen
- Australian permanent resident or
- eligible New Zealand citizen
- the relationship can be with someone of the same or different sex
The applicant and their fiancé are required to prove the following conditions:
- must be aged 18 or more
- must intend to marry before expiration of the visa
- genuinely intend to live together as married couple
- must have a sponsor, usually by their fiancé, at the time of making the application
- meet the health and character requirements
- paid back your debt to the Australian Government (if any)
- not have had a visa or previous application refused
Criteria For The Sponsor
The Sponsor must:
- be aged 18 or more
- be an Australian citizen, permanent resident or eligible New Zealand citizen
- provide information on relevant offence, which can be done by providing police certificates
- not have previously sponsored more than a person for a Partner Visa or Prospective Marriage Visa for migration to Australia, and not have sponsored a person for a Partner Visa or Prospective Marriage Visa for migration to Australia within the last 5 years
- not have been sponsored under a Partner Visa or Prospective Marriage visa by someone else within the last 5 years
Pathway To Permanent Partner Visa
Before the 9-month expiration has passed, the applicant and their fiancé must have married in order to be eligible for a Partner Visa which would grant permanent residency.
