Partner Visa Subclass 309 & Partner Visa Subclass 100
Both the partner visa subclass 309 and partner visa subclass 100 permit the spouse or de facto partner of an Australian citizen, Australian permanent resident, or eligible New Zealand citizen to permanently live in Australia.
Applicants have to first get a partner visa subclass 309 that will temporarily allow them to live and work in Australia for two years. They apply for both the visa subclass 309 and partner visa 100 subclass at the same time and pay only one fee of AUD $7,715. During that two year period, a permanent partner visa 100 will be processed for them.
Partner Visa Subclass 309 Criteria
- Applicants have to be outside of Australia when they lodge their application and when the decision has been made regarding their offshore partner visa application
- Be the spouse or de facto partner of an Australian citizen, a permanent resident, or an eligible New Zealand citizen
- Both the applicant and the spouse or de facto partner have to be at least 18 years old when the applicant applies for an offshore partner visa
- Have a sponsor if your partner is younger than 18 years of age; eligible sponsors include your partner’s parent or guardian who is either an Australian citizen, a permanent resident, or an eligible New Zealand citizen
- Adhere to the health and character requirements of this offshore partner visa
- Applicants must have repaid or have planned to repay all the debt they have to the Australian government (if any) before this offshore partner visa is approved
Partner Visa Subclass 100 Criteria
- Have a temporary partner visa subclass 309
- Still be in a relationship with your spouse or de facto partner unless the relationship has ended due to extraordinary circumstances
- Adhere to all the laws and conditions related to the Partner Visa Subclass 309
