Temporary Skill Shortage Visa

CRITERIA

The Temporary Skilled Shortage Visa (subclass 482) (‘TSS 482’) is a temporary visa that allows an employer to sponsor a skilled worker to take up employment where the employer could not hire a skilled Australian for such employment. This new TSS visa 482 was created to replace the Temporary Work (Skilled) Visa (subclass 457) effective from 18 March 2018.

The TSS 482 is further divided into 3 streams:

  • Short Term Stream
  • Medium-Term Stream
  • Labour Agreement Stream

SHORT TERM STREAM

Under this stream, an applicant can live and work in Australia for up to 2 years or even 4 years if an International Trade Obligation applies to the application. In order for an applicant to seek employment under this stream, the employers must prove that the employment is a genuinely temporary arrangement for overseas skilled workers whose occupation is listed under the Short-Term Skilled Occupation List(STSOL)

CRITERIA

  • Holder of an appropriate visa
  • Complied with previous visa conditions
  • Must be nominated by an approved sponsor
  • Work for your nominating employer
  • Must be a genuine applicant for entry and stay as a short-term visa holder
  • Have a suitable skills assessment of your occupation
  • at least two years of full time and relevant skilled work experience
  • Must have at least vocational English
  • Have health insurance
  • Meet the health and character requirements
  • Paid back your debt to the Australian Government (if any)
  • Sign the Australian values statement
  • Not have had a visa or previous application refused

PATHWAY TO PERMANENT RESIDENCY

Applicants holding the short term TSS 482 visa can apply for a new one if the current one is set to expire provided that your employer lodges a new nomination and the applicant continues to work for the current employer. Another option is that if the applicant’s occupation is listed under STSOL, the applicant may apply for other visas such the subclass 187, 190 or 489 visa which will lead to permanent residency

MEDIUM-TERM STREAM

Under this stream, an applicant can live and work in Australia for up to 4 years. In order for an applicant to seek employment under this stream, the employers must prove that the employment is a genuinely temporary arrangement for highly overseas skilled workers whose occupation is listed under the Medium and Long-Term Strategic Skilled List(MLTSSL)

CRITERIA

  • Holder of an appropriate visa
  • Complied with previous visa conditions
  • Must be nominated by an approved sponsor
  • Work for your nominating employer
  • Must be a genuine applicant for entry and stay as a short-term visa holder
  • Have a suitable skills assessment of your occupation
  • at least two years of full time and relevant skilled work experience
  • Must have at least vocational English
  • Have health insurance
  • Meet the health and character requirements
  • Paid back your debt to the Australian Government (if any)
  • Sign the Australian values statement
  • Not have had a visa or previous application refused

PATHWAY TO PERMANENT RESIDENCY

Applicants holding the medium TSS 482 visa can apply for a new one if the current one is set to expire provided that your employer lodges a new nomination and the applicant continues to work for the current employer. Another option is that where an applicant has been working for the same employer in Australia for three years or more is eligible to apply for Permanent Residency either through the Transitional Stream such as Employer Nominated Scheme (subclass 186 ENS) or the Regional Employer Sponsored Scheme (subclass 187 RSMS) or through the permanent stream such as Skilled Independent visa (subclass 189) and Skilled nominated visa (subclass 190)

LABOUR AGREEMENT STREAM

Under this stream, an applicant can live and work in Australia for a maximum of 4 years depending on the terms of the Labour Agreement. In order for an applicant to seek employment under this stream, the employers, who are nominating the applicant, must have a labour agreement with the Commonwealth of Australia

CRITERIA

  • Have an occupation nominated under the labour agreement
  • Must be nominated by an employer
  • at least two years of full time and relevant skilled work experience
  • Must have at least vocational English unless English requirements are specified in the labour agreement
  • Meet the health and character requirements
  • Have health insurance
  • Paid back your debt to the Australian Government (if any)
  • Sign the Australian values statement
  • Not have had a visa or previous application refused

PATHWAY

Applicants holding the Labour Agreement TSS 482 visa can apply for a new one if the current one is set to expire provided that your employer lodges a new nomination and the applicant continues to work for the current employer. Another option is that an applicant, depending on the nature and terms of their Labour Agreement, may be eligible to apply for Permanent Residency either through the Transitional Stream such as Employer Nominated Scheme (subclass 186 ENS) or the Regional Employer Sponsored Scheme (subclass 187 RSMS).
