Business Visa

The Home Affairs offers whose who are running a business or those with a talent of business to apply for business visa in Australia on a temporary basis. A business visa (subclass 188) allows you to run your own business or investment and take up entrepreneurial activities in Australia. After holding the subclass 188, an applicant can apply for permanent residency under the Business Innovation and Investment (Permanent) Visa (subclass 888)

The business visa is divided into 5 streams, which are as follows:

188A BUSINESS INNVOATION

This points-based stream is only available to those applicants who are nominated by an Australian State or Territory and pass the points. Application for this stream can be made either onshore or offshore. This visa allows the applicant to conduct a business and to stay up to 4 years in Australia.

CRITERIA

  • be nominated by an Australian State or Territory
  • have an ownership stake in at least one business
  • own personal and business assets of at least $800,000
  • have a minimum requirement of at least 65 points (need points table)
  • have a successful business career
  • Must be aged 55 or under
  • No history of unacceptable activities
  • Must have at least functional English
  • Meet the health and character requirements
  • Sign the Australian values statement
  • Paid back your debt to the Australian Government (if any)
  • Not have had a visa or previous application refused

188B INVESTOR STREAM

This points-based stream is only available to those applicants who pass the points and have the ability to invest at least $1.5 million an Australian State or Territory and are nominated by an Australian State or Territory. Application for this stream can be made either onshore or offshore. This visa allows the applicant to conduct a business and to stay up to 4 years in Australia and that the applicant must reside in their nominating State for at least 2 years

CRITERIA

  • be nominated by an Australian State or Territory
  • own personal and business assets of at least $2.25 million and make an investment of $1.5 million in the nominating state or territory
  • have the right experience
  • have a minimum requirement of at least 65 points (need points table)
  • intend to live in the nominating state or territory for at least 2 years
  • Must be aged 55 or under
  • No history of unacceptable activities
  • Must have at least functional English
  • Meet the health and character requirements
  • Sign the Australian values statement
  • Paid back your debt to the Australian Government (if any)
  • Not have had a visa or previous application refused

188C SIGNIFICANT INVESTOR VISA (SIV) STREAM

This provisional stream is available to those applicants who can invest at least $5 million in Australia and are nominated by an Australian State or Territory. Application for this stream can be made either onshore or offshore. This visa allows the applicant to conduct a business and to stay up to 4 years in Australia and that the applicant must reside in their nominating State for at least 2 years. There is no upper age limit or any English language requirement under this stream.

CRITERIA

  • be nominated by an Australian State or Territory
  • make an investment of $5 million in Australia
  • No history of unacceptable activities
  • Must have at least functional English
  • Meet the health and character requirements
  • Sign the Australian values statement
  • Paid back your debt to the Australian Government (if any)
  • Not have had a visa or previous application refused

188D PREMIUM INVESTOR (PIV) STREAM

This provisional stream is available to those applicants who can invest at least $15 million in Australia and are nominated by the Austrade. This visa allows the applicant to conduct a business and to stay up to 4 years in Australia. Application for this stream can be made either onshore or offshore. There is no upper age limit under this stream but an applicant must submit an Expression of Interest.

CRITERIA

  • be nominated by the Austrade
  • receive an invitation to apply
  • make a complying premium investment of $15 million in Australia
  • No history of unacceptable activities
  • Agree not to bring an action against the Commonwealth for a loss relating to complying with the premium investment
  • Must have at least functional English
  • Meet the health and character requirements
  • Sign the Australian values statement
  • Paid back your debt to the Australian Government (if any)
  • Not have had a visa or previous application refused

188E ENTREPRENEUR STREAM

This provisional stream is available to those applicants who are nominated by the Australian State or Territory and must submit an Expression of Interest. This visa allows the applicant to conduct a business and to stay up to 4 years in Australia. Application for this stream can be made either onshore or offshore.

CRITERIA

  • be nominated by an Australian State or Territory
  • receive an invitation to apply
  • must be aged 55 or under unless the State or Territory government agency has determined your proposed entrepreneur activity will be of exceptional economic benefit.
  • Have a complying entrepreneur activity
  • Receive funding from an approved entity
  • Must have at least competent English
  • Meet the health and character requirements
  • Sign the Australian values statement
  • Paid back your debt to the Australian Government (if any)
  • Not have had a visa or previous application refused
